PRE-INSPECTION AGREEMENT

This agreement is made between Michael Rigney, (Hereinafter known as “Inspector”) and the undersigned (hereinafter known as “Client”).

 

The Parties Understand and Agree as follows:

Inspector guarantees to perform a visual inspection of the home and to provide client with a written inspection report identifying the defects that inspector both observed and deemed material.  Inspector may offer comments as a courtesy, but these comments will not comprise the bargained-for report. The report is only supplementary to the seller’s disclosure.

 

Inspector agrees to perform the inspection in accordance to the current Standards of Practice of the National Association of Certified Home Inspectors posted at NACHI Standards of Practice. It is understood and agreed that the inspection will be of readily accessible areas of the building and is limited to visual observations of apparent conditions existing at the time of the inspection only. Latent and concealed defects are excluded from the inspection.

 

Client understands that the inspection will be performed in accordance to the aforementioned Standards, which contain certain limitations, exceptions, and exclusions.

 

This inspection and report do not address and are not intended to address the possible presence or danger from any potentially harmful substances and environmental hazards including, but not limited to radon gas, lead paint, asbestos, urea formaldehyde, toxic or flammable chemicals, mold spores or water and airborne hazards. Also excluded are inspections of and reporting on swimming pools, well/septic systems, security systems, central vacuum, water softeners, sprinkler systems, fire and safety equipment.

 

The inspection and report are performed and prepared for the use of client, who gives inspector permission to discuss observations with real estate agents, owners, repairpersons, and other interested parties. Inspector accepts no responsibility for use or misinterpretation by third parties.

 

The report is not a comprehensive evaluation of items to be inspected, but only of readily visible or detectable conditions present at the time of the inspection. The report should not be considered an insurance policy against conditions, which exist as to the items not inspected or to the future condition of items inspected. The Company shall not be liable for the failure to report water leaks or evidence of leakage, which were not apparent at the time of the inspection or concealed from view, but which may become evident at a later time.
The parties agree that the inspector, assume no liability or responsibility for the cost of repairing or replacing any unreported defect or deficiency, either current or arising in the future or for any property damage, consequential damage or bodily injury of any nature.

 

A Wood Destroying Organism (WDO) structural pest inspection will be performed by Mike Rigney WSDA license # 378 using the standards of the Washington State Pest Control Association, at: WSPCA Structural Inspection Standards  

The inspection and report are not intended or to be used as a guarantee or warranty, expressed or implied, regarding the adequacy, performance or condition of any inspected structure, item or system.

The inspector is not an insurer of any inspected conditions.

                                                                                                                  

In the event of a claim against inspector, client agrees to supply inspector with the following: (1) Written notification of adverse conditions within 14 days of discovery, and (2) Access to the premises. Failure to comply with the above conditions will release inspector and its agents from any and all obligations.

 

In the event that client fails to prove any adverse claims against inspector in a court of law, client agrees to pay all legal costs, expenses and fees of inspector in defending said claims.

 

If any court declares any provision of this Agreement invalid or unenforceable, the remaining provisions will remain in effect.  This agreement represents the entire agreement between the parties.  No change or modification shall be enforceable against any party unless such change or modification is in writing and signed by the parties.  This Agreement shall be binding upon and enforceable by the parties and their heirs, executors, administrators, successors and assignees. Client shall have no cause of action against inspector after one year from the date of the inspection.

 

The parties agree that this report is for the exclusive use of the client. The inspection report is not to be relied upon by any third party nor may it be transferred to a third party. Distribution of the contents of this report to any third party shall be the responsibility of the client.

 

The above is understood and agreed to, and client acknowledges receipt of a copy of this agreement.
